Welcome to RPGLink, a text-based roleplaying hosting platform. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and RPGLink, a Florida-based entity ("we", "us", "our", "Site Operators") regarding your access to and use of the Site, including all associated forums, private messages, character profiles, roleplay threads, chat features, and any related services (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree, you must not access or use the Service. We operate in compliance with applicable U.S. federal laws, including but not limited to 18 U.S.C. § 230 (Communications Decency Act, providing immunity for user-generated content on interactive platforms), and relevant state laws as outlined below.

1. Eligibility & Age Requirement

• You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account or use the Service in any capacity. This aligns with federal requirements under 18 U.S.C. § 2257 (Record keeping requirements for depictions of simulated sexually explicit performances) and state laws such as Florida Statutes § 847.013(2) (Prohibiting the sale or distribution of harmful materials to minors) and California Penal Code § 313 (Harmful matter to minors).
• You represent and warrant that you are of legal adult age in your jurisdiction and that all information you provide (including date of birth) is accurate and truthful.
• No persons under 18 may use the Service under any circumstances. We do not knowingly permit minors to access or participate. Suspected underage use will result in immediate permanent termination and reporting to appropriate authorities where required by law, including mandatory reporting under 18 U.S.C. § 2258A (Reporting requirements of providers) and Florida Statutes § 827.071 (Sexual performance by a child; penalties).

2. Nature of the Service - Adult Content Allowed

The Service is an 18+ platform that permits users to engage in fictional, text-based roleplay of all genres and themes, including explicit adult erotic roleplay (ERP), provided all content complies with these Terms and applicable laws.

We allow consensual, fictional depictions of adult sexual themes, BDSM, kink, fetish content, and other mature/erotic subject matter between characters portrayed as consenting adults (18+). Such content must not violate federal obscenity laws under 18 U.S.C. § 1460 et seq. (Obscene matter), Florida Statutes Chapter 847 (Obscene literature; profanity), or California Penal Code § 311 et seq. (Obscene matter).

3. Strictly Prohibited Content & Conduct

The following are strictly forbidden and will result in immediate account termination (permanent ban) without refund, and may be reported to law enforcement. Violations may constitute criminal offenses under federal and state laws:

3.1 Underage Content (Absolute Zero-Tolerance)

• Any depiction, suggestion, implication, roleplay, discussion, or fantasy involving characters under the age of 18 in a sexual, erotic, romantic, or exploitative context — even if fictional, "aged-up", historical, fantasy species, or claimed to be "of age in their world". This is prohibited under 18 U.S.C. § 2256 (Definitions relating to child pornography, including visual depictions of minors), Florida Statutes § 847.0135 (Computer pornography; prohibited computer usage; traveling to meet minor; penalties), and California Penal Code § 311.11 (Possession or control of child pornography).
• Use of any terminology, nicknames, or descriptors that imply or can reasonably be interpreted as referring to minors in a sexual context (loli, shota, underage, teen, schoolgirl/boy in sexualized context, etc.).
• Any attempt to roleplay, solicit, or discuss sexual content with a user you know or suspect is under 18, which may violate 18 U.S.C. § 2422 (Coercion and enticement of minors) and state equivalents like Florida Statutes § 847.0138 (Transmission of material harmful to minors to a minor by electronic device or equipment prohibited).

3.2 Bestiality / Zoophilia

• Any sexual or erotic content involving animals, anthropomorphic animals in non-consensual/bestial contexts, or real-world animals in a sexual manner. This may violate federal animal cruelty laws under 18 U.S.C. § 48 (Animal crush videos, extending to depictions) and state laws such as Florida Statutes § 828.12 (Cruelty to animals) or California Penal Code § 597 (Cruelty to animals), when interpreted in the context of obscene depictions.

3.3 Other Prohibited Categories

• Non-consensual sexual activity (rape, dubcon presented as non-con without prior OOC negotiation & consent markers, sexual assault as erotic content), which may implicate laws like 18 U.S.C. § 1591 (Sex trafficking of children or by force, fraud, or coercion).
• Extreme gore / snuff / necrophilia presented as erotic content (contextual dark fiction may be allowed in clearly non-erotic horror threads — contact moderation for clarification), potentially violating obscenity standards under Miller v. California (413 U.S. 15, 1973) as applied in federal and state law.
• Real-world doxxing, harassment, stalking, threats, or sharing private personal information, prohibited under 18 U.S.C. § 2261A (Stalking), Florida Statutes § 784.048 (Stalking; definitions; penalties), and California Penal Code § 646.9 (Stalking).
• Content that violates applicable law (child sexual abuse material, terrorist content, etc.), including but not limited to the above-cited statutes.

4. Consent & Roleplay Etiquette

• All erotic roleplay must be 100% consensual between participants. Clear, affirmative, ongoing OOC (out-of-character) consent is required, in line with principles under federal and state sexual assault prevention laws.
• Use of content warnings, safewords, limits lists, and OOC negotiation is strongly recommended and may be required in certain communities on the Site.
• "No means no" — if a partner uses a safeword, says stop OOC, ghosts, or otherwise indicates non-consent, the scene must end immediately.
• You may not pressure, guilt, badger, or retaliate against another user for refusing or ending ERP, as this could constitute harassment under applicable laws cited in Section 3.3.

5. User Content & Responsibility

You retain ownership of the text you post, but grant us a worldwide, non-exclusive, royalty-free license to host, display, moderate, and (if necessary) remove it. You are solely responsible for all content you create or share. We are not responsible for user-generated content but reserve the right (without obligation) to monitor, moderate, edit, or remove any content at our sole discretion, as permitted under 18 U.S.C. § 230(c)(2) (Good Samaritan protection for voluntary content moderation). We comply with data privacy obligations, including the California Consumer Privacy Act (CCPA, Cal. Civ. Code § 1798.100 et seq.) for California residents, and refer you to our separate Privacy Policy for details.

6. Account Termination & Moderation

We may suspend or permanently ban any account for violation of these Terms (or for any other reason) without notice or refund. Decisions of Site staff / moderators are final. We may report violations to authorities as required by law, such as under 18 U.S.C. § 2258A or Florida Statutes § 39.205 (Reporting child abuse, abandonment, or neglect).

7. No Endorsement - Fictional Content Only

All roleplay is fictional. Nothing on the Site constitutes real-world advice, endorsement, or encouragement of illegal or harmful acts. We disclaim any liability for user content under 18 U.S.C. § 230.

8. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance of the new Terms.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, as the servers are hosted in Florida. However, for users in California, certain provisions may be subject to California law where mandated, such as under Cal. Civ. Code § 1642 (Choice of law in contracts) or CCPA requirements. Any disputes shall be resolved exclusively in the courts of Orange County, Florida (encompassing Orlando, where operations are based).
